TERMS AND CONDITIONS OF SERVICE

1. General Information and Jurisdiction

These terms establish the conditions under which Diesel Premier del Pacífico (hereinafter, "the Company") provides diagnostic, maintenance, repair, and marine propulsion and power generation component sales services. By requesting or contracting any of our services, the client expressly accepts these terms. For the interpretation, compliance, and execution of these terms, the parties submit to the applicable laws and competent courts of the United Mexican States.

2. Services and Quotations

All quotations issued by the Company, whether for preventive maintenance, major repairs (overhaul), or component supply, are strictly valid for 15 calendar days from the date of issuance. To initiate any diagnostic or field work, it is an indispensable requirement to have prior authorization from the vessel owner or their legal representative. Furthermore, the client is responsible for obtaining and guaranteeing all necessary access permits if the vessel is located within a marina, shipyard, or port facility.

3. Payment Policy

To confirm the scheduling of any technical service, diagnostic, or repair work, a 50% down payment of the total quoted amount is required. The remaining 50% must be paid in full immediately upon completion of the agreed-upon tasks, prior to the operational handover of the serviced equipment.

4. Cancellation Policy

We understand that maritime operations are subject to unforeseen changes. Any cancellation of a previously scheduled service will not incur any charges, provided that the Company is notified with at least 12 hours' notice. In the event that the service is cancelled outside of this timeframe, or if the technical personnel are already at the vessel's location awaiting access or site preparation, the client will be billed for the corresponding lost operational time.

5. Component and Parts Warranties

The Company operates under the highest technical quality standards. Regarding original parts, spare parts, and components supplied and installed during maintenance or repair work, these carry solely and exclusively the manufacturer's factory warranty. The Company acts as a facilitator for claims of such warranties but does not issue independent extended warranties on parts.

6. Limitation of Liability

Diesel Premier del Pacífico commits to executing its technical tasks with the utmost diligence and professionalism. However, the Company assumes no civil, criminal, or financial responsibility for any collateral effects derived from the time required for diagnostics, the importation of spare parts, or the final repair of the equipment. This absolutely excludes any claims for loss of profit, loss of income, port fines, cancellation of charter contracts, itinerary alterations, or any other indirect damage suffered by the vessel or its owners during the downtime period.

7. Intellectual Property and Website Use

All content hosted on the Company's website, including, but not limited to, descriptive texts, technical articles, logos, visual identities, photographs, and downloadable documents, is the exclusive property of Diesel Premier del Pacífico. The reproduction, copying, distribution, modification, or commercial use of such material by third parties without the Company's prior written consent is strictly prohibited. Access to the website does not grant any license or right to use the Company's intellectual property.
